On Tuesday (Jun 26), the Supreme Court ruled that Trump has the authority to ban travelers from certain majority-Muslim countries if he thinks it is “necessary to protect the United States.”  In a 5 to 4 vote, with conservatives in the majority and Chief Justice John G. Roberts Jr. writing the opinion, the highest court passed the ban definitively.

After news broke of the decision, Trump took to Twitter to express his excitement over passing the policy that he has been pushing since being announced president: “SUPREME COURT UPHOLDS TRUMP TRAVEL BAN. Wow!”

After the ruling, the White House issued a formal response taking a jab at his “declared enemies”, calling the ruling “a vindication following months of hysterical commentary from the media and Democratic politicians who refuse to do what it takes to secure our border and our country.”

Despite the ban being struck down in the lower courts which was first issued in January 2017, the Supreme Court claims that the ruling was only in favor due to Trump working within his political scope of power.

According to the Washington Post Supreme Court Justice John G. Roberts Jr. attempted to downplay the blatant political aspects of the case, by writing that the presidential proclamation that led to the ban “is squarely within the scope of presidential authority” and rejected arguments that the order was biased because of the predominant religion of most of the affected countries.

“The Proclamation is expressly premised on legitimate purposes: preventing entry of nationals who cannot be adequately vetted and inducing other nations to improve their practices,” Roberts wrote. “The text says nothing about religion. We express no view on the soundness of the policy.”

The current ban, issued last fall, barred various travelers from eight countries, six of them with Islam being the majority. The countries listed are Syria, Libya, Iran, Yemen, Somalia, North Korea and Venezuela.
